1Who these terms are between
These terms apply between Appify (Pty) Ltd, trading as Foodee, of 7 San Sabastian Road, Ballito, 4420, South Africa, and you, the person using Foodee.
By using Foodee, you agree to these terms. If you don't agree, don't use Foodee.
2What Foodee is
Foodee is a service that helps you discover restaurant specials in your area. It works by showing you specials that restaurants have posted directly. We don't make the specials, set the prices, or guarantee that any restaurant honours its own posted special — that's between you and the restaurant.
Foodee is a free service. We may also offer paid features ("Foodee+") for additional functionality.
3Using Foodee
You may use Foodee for personal, non-commercial purposes. You may not:
- Use Foodee for any purpose that's illegal under SA law
- Scrape, copy, or systematically collect Foodee's content
- Impersonate a restaurant or another user
- Attempt to break Foodee or interfere with how it works
- Use Foodee to harass restaurants or other users
If you breach these in a serious or repeated way, we may suspend or end your access.
4Accounts and authentication
You don't need an account to browse Foodee. To use Foodee+ or save specials across devices, you sign in by email — we send you a one-time link, no password.
You're responsible for keeping your email account secure. If someone has access to your email, they can sign in as you on Foodee. Use a secure email account.
5Foodee+ subscriptions
Foodee+ is a paid subscription. Pricing and features are described in the Foodee+ upgrade screen at the time you subscribe.
How billing works
- Subscriptions renew automatically until you cancel
- Payment is processed by PayFast — Foodee doesn't see your card details
- You can cancel any time from your Foodee profile or by emailing us
- When you cancel, you keep Foodee+ until the end of the period you've paid for, then revert to free Foodee
Refunds
If a payment is taken in error or you're unhappy with Foodee+, email us and we'll resolve it fairly. SA consumer law (CPA) protects you here — we honour the legal cooling-off period of 5 business days for distance contracts.
6What we promise
We try our best to make Foodee work well and stay honest about what it shows. But we're a small project and Foodee is a free service for diners; we provide it as is without warranties beyond what SA consumer law requires us to provide.
What this means in practice:
- We can't guarantee any specific restaurant or special will be available
- We can't guarantee Foodee is up 100% of the time
- We can't guarantee prices shown match what you'll pay (restaurants set their own prices)
- We can't guarantee map directions, drive times, or distance calculations are perfect
When you visit a restaurant based on something you saw on Foodee, your transaction is with the restaurant, not with us. If something goes wrong (the special isn't actually on, the price differs, the restaurant is closed), tell us so we can flag it to the restaurant — but the dispute itself is between you and them.
7What we don't do
We don't:
- Sell your data
- Share individual information about you with restaurants
- Track you across other apps or websites
- Show advertising
If any of this changes (it won't), we'll tell you well in advance.
8Content from restaurants
The information about specials on Foodee comes from restaurants directly. We do basic checking when restaurants sign up but we can't verify every post. If you see something that looks wrong, tell us.
We may remove content that violates these terms, that's been flagged by users, or that we believe is misleading or harmful.
9Liability limits
To the extent allowed by SA law, our liability for any claim related to Foodee is limited to:
- For free users: the amount you've paid us (R0)
- For paying users: the amount you've paid in subscription fees in the last 12 months
This doesn't limit liability for things SA law doesn't allow us to limit (such as gross negligence, intentional harm, or breach of CPA-mandated protections).
10Changes to these terms
We may update these terms. If changes are material, we'll tell you at least 30 days before they take effect. If you don't agree to the new terms, you can stop using Foodee.
11Governing law and disputes
These terms are governed by South African law.
If you have a dispute with us, we'd much rather resolve it directly — email us and we'll work it out. If we can't resolve it directly:
- For consumer disputes (CPA matters), the National Consumer Commission is the relevant body
- For other disputes, South African courts (specifically the High Court of KwaZulu-Natal, where Foodee is based) have jurisdiction
We will not require you to arbitrate or waive any rights you have under SA consumer protection law.
